When you are injured, you will be faced with various forms of damage. One of those damage items is healthcare damage, consisting of the costs of care, nursing and guidance that you need to recover after the accident. Care damage must also be fully compensated by the liable party. We can advise you on this and guide you through the claims settlement process.
What is healthcare damage?
Healthcare claims include the following cost items:
- The costs of nursing and care, such as informal care or home care
- The cost of domestic help
- The costs of practical help, such as shopping, gardening and pet care
- The costs of facilities, such as home modifications or transport facilities
In addition to the types of care and assistance mentioned, other forms of care and facilities may also form part of the health care damage item.
Public settlement or claim for damages?
There are various statutory schemes that claim reimbursement of care and facilities, such as the Long-Term Care Act and the Social Support Act. It is up to you to determine whether to apply for a benefit under a public scheme, or to arrange it yourself and claim the costs from the liable party. The body where you submit an application must process it, whereby your interests must be central. Your lawyer will help you to process the application correctly and expeditiously.
Care Damage Handbook
The Personal Injury Council has drawn up a guideline for care damage in the event of personal injury, which states that the victim is entitled to compensation for the necessary care. The guide provides starting points for determining the need for care and the amount of the care costs. This tool of the Personal Injury Council has been drawn up to improve the position of personal injury victims.
