Damage as a result of an accident: don’t forget your travel costs!

Have you suffered personal injury as a result of an accident? You will then incur various forms of damage. Health damage, but also financial damage. Did you know that travel expenses related to personal injury are eligible for reimbursement? This article by MCJ Advocatuur is about that.

Determination of the damage

The Personal Injury Guideline for Mileage Reimbursement is used to determine the Travel Expenses claim. The guideline covers travel costs of family and close relatives for visiting the victim in hospital and during a temporary stay in a rehabilitation center. Travel costs of the victim for visits to doctors, physiotherapists and other professionals involved in medical treatment, as well as for visits to a Victim Support Office and other advocates are also included in the damage.

Amount of compensation

The guideline sets a standard amount per kilometer. The standard amount in the Mileage Reimbursement Directive is €0.33 as of January 1, 2023. This amount is evaluated annually and, if necessary, indexed based on data and calculations from the ANWB.

Both fuel and electric cars

You may wonder whether a different amount is charged for electric cars. That is not the case. The Personal Injury Council has calculated that the difference in total costs per kilometer of an electric car compared to a fuel car is only 1 cent. Due to the negligibly small difference, the standard according to the Mileage Reimbursement Directive is used for both electric cars and fuel cars.

Important tips

  • Keep track of all your kilometers driven per destination, for example in your agenda, a notebook or in a word file
  • Also keep your bus, train and metro tickets and write down the destination
